SafeDrivePod International B.V. is a Dutch private company specialised in developing traffic applications. These terms of use have been prepared by SafeDrivePod International B.V. and apply to this company and its subsidiaries and affiliates. They will hereinafter be collectively referred to as 'SafeDrivePod'.
- The SafeDrivePod app, in combination with the SafeDrivePod device, allows you to automatically lock your smartphone screen while driving. This protects yourself and other road users by preventing you from being distracted by your smartphone while driving.
- This app is for protection purposes only.
- This app uses your smartphone's hardware, i.e. Bluetooth (Bluetooth Low Energy or BLE), possibly location services (global positioning system or GPS) and phone functions (only for recognising the beginning or end of a phone call).
- Location services and phone functions in particular are privacy-related. However, no location or call data is stored in the phone's memory or in the cloud. See below for more information regarding our privacy policy.
- You acknowledge that the functionality of the app may be affected by changes to your device's operating system. It is your sole responsibility to check for updates to determine whether you have installed the most recent version of the app to ensure that the app functions correctly.
- Neither SafeDrivePod nor its subsidiaries, affiliates and/or their respective employees or management shall be liable for any damages including, without limitation, direct, indirect, consequential or incidental damages arising out of or in connection with any use, information, materials, qualifications or recommendations related to this app.
- SafeDrivePod shall not be liable for any damages arising from the use (or inability to use) this app, including damages caused by viruses or inaccuracy or incompleteness of the technology. SafeDrivePod shall also not be liable for any damage arising from the use of electronic devices to communicate with this app, including, but not limited to, damage caused by failure or delay in the arrival of electronic messages, interception or manipulation of electronic messages by third parties or by software/hardware used for electronic communication and transmission of viruses.
- If this app contains direct or indirect links to other sources of information, such as information on websites maintained by third parties over which SafeDrivePod has no control, SafeDrivePod is not liable for the use or content of such information.
- SafeDrivePod reserves the right to change the SafeDrivePod app terms of use at any time and without notice.
- These terms of use have been drafted and should be interpreted in accordance with Dutch law. Any disputes arising from these terms of use shall be settled by the competent court in Amsterdam.
